Personal Training Membership Agreement

Membership Level

During the enrollment process, you have selected a particular level of membership. You understand that your access to classes and sessions is determined by your selection.

Class/Session Cancellations + Fees

Please email me at hello@tesslorraine.com to cancel your class or session at least 24 hours prior to your scheduled start time as a courtesy to other clients who may be on the waitlist. 

The exception to this rule, however, is anything health-related. If you or an immediate family member feels sick, gets hurt, or is struggling with health in any way (mental health included), just cancel your session AND send us an email to let us know any time before your scheduled start time. Your health and safety come first.

If you do not show up for a scheduled session, you will be charged a $20 no show fee. You will also lose your class credit, if applicable.

Late-Shows

Come late. We really don't care. Truly. You don't even have to give us a heads up. Chances are, if you're scrambling and running late, you probably need movement more than ever. Just come in and start warming up. We'll get you caught up as soon as we're able.

Class ends when class ends. If you show up 30 minutes late to a 50 minute class, a 20-minute workout is so much better than no workout at all!

Scheduled Closures

I take regular time off for rest, inspiration, continuing education, and adventure. Here’s how that works.

I do not work for 4 full weeks each calendar year. This means that I train folks 48 weeks per year, and each monthly membership fee includes 4 weeks of classes/sessions. The exact dates will be sent to you via email at least 30 days in advance. No refunds will be given for these scheduled  closures.

If I ever need to cancel unexpectedly due to sickness or emergency, you’ll have two options: reschedule or refund. I’m happy to find a time to reschedule if possible. Otherwise, your next month’s membership will be discounted accordingly.

Membership Holds & Termination

In the event of injury or illness, your membership may be put on hold until you have fully recovered, without any loss of sessions.

In the case of extended travel (2 weeks or more), please let us know in advance to receive a prorated discount on your next membership fee.

Unused credits will expire (60) days from the date of purchase unless otherwise stated.

In the event that you wish to cancel your membership, you may do so by logging into your account or sending a written request via e-mail. Written cancelation requests must be made three days prior to your monthly payment date to ensure the cancellation is processed on time.

We reserve the right to terminate your access without notice in the event that this Agreement is violated.

Refund Policy

Due to the nature of our products, refunds will not be given for payments that have been processed. However, if you’re not satisfied, for any reason, please share your concerns with us via email at hello@tesslorraine.com and we’ll do our best to make things right.

You agree to not engage in monetary chargebacks of any nature and to only seek a refund in accordance with this Agreement.

Guarantees

No express or implied guarantees or warranties are made as to the results achievable by Member.

Medical Advice

Tess Lorraine Inc. is not a doctor and cannot provide medical advice, opinions, or recommendations. If you need medical advice, you should hire a medical professional. You understand that the information and instruction provided as part of your membership is not medical advice and Company is not a medical professional.

All of the information provided including the resources delivered via e-mail, video/audio recordings, website content, digital resources available for purchase, social media, and live events educating people about movement, strength training, yoga, and/or principles affecting their health are resources for educational and informational purposes only and should not take the place of hiring a licensed professional. You should not act, or refrain from acting, on the basis of information provided by Company without first consulting your doctor.

User Registration

Upon joining, you may be required to create a log-in in order to access the programs, platform, and content. You agree to maintain the confidentiality of this log-in information and to not allow or enable any third parties to access the platform using your log-in credentials.

Privacy

Transferability

Member cannot transfer this Agreement to any other entity or individual. Any potential transfer may only take place with the written permission of Company.

Governing Law & Interpretation

The laws of the state of Oregon will govern the validity, construction, and performance of this contract. Any actions relating to this contract will be handled in courts serving Jackson County, Oregon.

In the event of a dispute, the first course of action to be sought by either party, after making a good-faith and reasonable effort attempting to resolve the matter amicably, shall be mediation with a mutually agreed upon mediator. Parties shall share in the costs.

Wherever possible, each provision of this contract will be interpreted so that it is valid under applicable law. If any provision is held illegal or unenforceable, that provision will be reformed to the extent necessary to make the provision legal and enforceable. All remaining provisions will remain unaffected and will continue in full force and effect.

Electronic Signature

You understand that under law, signatures transmitted digitally and created electronically via touchscreen or computer mouse shall have the same force and binding effect as an original handwritten signature in ink.

The parties have executed this Agreement on the date of enrollment by Member. Completion of enrollment, payment by Member, and granted access to the Site constitutes our Agreement.
